New planning controls introduced for Houses in Multiple Occupation across Walsall

New planning controls for Houses in Multiple Occupation (HMOs) have been introduced to help maintain balanced communities and ensure good standards of housing across Walsall.

Through public consultation and cabinet meeting, the council approved an Article 4 Direction to manage HMOs in the borough.  

The Article 4 Direction removes permitted development rights that previously allowed smaller HMOs—properties occupied by between three and six unrelated individuals sharing basic amenities—to be created without planning permission. 

This means that planning permission is now required for the development of all HMOs in Walsall, regardless of size. The change gives the council greater oversight of where HMOs are developed and ensures they are located and managed appropriately. 

“ HMOs have a role to play in providing much-needed housing options across the borough. However, it’s vital that they are developed and managed in a way that supports sustainable and well-balanced communities.

“Poorly managed HMOs can lead to a range of issues such as increased fly-tipping, anti-social behaviour, and waste accumulation. These new planning controls allow us to take a more strategic approach, helping to protect neighbourhoods while ensuring quality housing standards are maintained.” “

The Article 4 Direction applies across the whole borough, coming into force on October 1, 2025. Anyone seeking to convert a property into an HMO must now apply for planning permission from Walsall Council before development begins.
