Compliance of Conditions

Compliance of condition(s)
It is possible to obtain written confirmation from the Council that a condition attached to a planning permission has previously been complied with.
Requests for confirmation of compliance with planning conditions must be submitted in writing and provide the following details:
The planning reference number 
A plan describing the application site 
Details of the conditions the application relates to 
A contact address for the applicant
How to apply

The government has set a mechanism for confirmation of conditions the guidance note requests that the Standard Application Form (application for the approval of details reserved by a condition) must be used to set out the details which applicants would like the local planning authority to consider.


The fee chargeable by the authority is £116 per request (or £34 where the related permission was for extending or altering a dwelling house or other development in the curtilage e.g. garden of a dwelling house) as set out in Regulation 16 of the 2012 Fees Regulations. A request can cover one or more conditions or limitations.

Determination time

The council will endeavour to handle all such requests speedily, but in any event we will reply within the statutory time limit of 8 weeks or any longer period agreed in writing between the applicant and the Council. If a response is not received within 12 weeks, the fee will be refunded.


infoi) The application fee is per request and there is no limit to the number of conditions that can be included within each submission.


ii) Any confirmation given would be without prejudice to any ongoing requirements of any condition (e.g. to maintain soft landscaping for a period of 5 years following completion of the planting scheme).
