Duty to Consult on felling street trees

The 'Duty to Consult' gives residents an opportunity to express their views on the proposed removal of street trees in their area.
On the 30th of November 2023 the requirement for local authorities to consult on the felling of street trees became a statutory duty under Section 115 of the Environment Act.
This legislation was introduced nationally to ensure local people can express their views over the proposed management of street trees in their locality. The aim of the duty is to ensure a more transparent decision-making process and to consider the views of local people.
The Council has worked with Transport for West Midlands to bring forward the A34 SPRINT (bus rapid transit) scheme. SPRINT Phase 2 infrastructure works were considered at Walsall Council Cabinet on 10 December 2025, where the scheme design was endorsed including the necessary removal of four highway trees to allow the SPRINT vehicles to operate along Darwall Street.
The trees proposed to be removed are two outside TSB Bank and two outside the former Post Office at Darwall Street.
This public consultation period is open for 28 days from 23rd September 2026. Residents are urged to send their comments on the proposed tree removal during this period to Cleanandgreen@walsall.gov.uk.
